South Asian Political Thought (SAPT) Discussion Group: MT18 Week 3: Constitutional Morality: An Approach to Constitutional Interpretation
Wednesday 24 October, 5:00pm to 6:30pm
The Habakkuk Room, Jesus College
Convener(s): Udit Bhatia & Amogh Dhar Sharma
Speaker(s): Surbhi Shukla, University of Oxford
Shukla's paper examines how judges ought to interpret a constitution. After exploring various competing approaches, she advances the 'constitutional morality' approach. On this account, judges are required to take moral calls, but in ways that are constrained, in a particular way, by the constitutional text, drafts, debates, historical context and normative aspirations which framed the constitution.
Surabhi Shukla is a DPhil Candidate in Law (University of Oxford).
